Terms of Service
The terms and conditions for using The Rugby Factory platform.

1. Eligibility
1.1 Minimum Age
Users must be at least 16 years old to create independent accounts. Registration confirms you are at least 16 and all provided information is accurate.
1.2 Guardian-Managed Profiles (Ages 13–15)
Players aged 13–15 may participate through Guardian-Managed Profiles created by a parent or legal guardian aged 25 or older.
1.3 Children Under 13
Children under 13 cannot use the platform.
1.4 Age Misrepresentation
False age information breaches these Terms and may result in suspension or termination.
1.5 Age Verification
The company reserves the right to request verification including date of birth, credit card authorisation, identity documents, or other reasonable methods. Non-compliance may trigger restrictions.
1.6 Authentic Accounts
Accounts must be operated by real individuals. Automated, bot, impersonation, or fraudulent accounts are prohibited.
1.7 No Guarantee of User Accuracy
The company cannot guarantee user accuracy and accepts no liability for misrepresentation.
2. Account Responsibilities
2.1 Security
You are responsible for maintaining login confidentiality and all account activity. Notify the company immediately of unauthorised access.
2.2 Accuracy
You must keep your information accurate and current.
2A. Guardian-Managed Profiles
2A.1 Overview
Guardian-Managed Profiles enable youth participation under parental supervision until age 16.
2A.2 Guardian Requirements
Guardians must be at least 25 years old, hold an active account, complete SMS OTP verification, and confirm legal guardian status. One guardian may manage up to five profiles.
2A.3 Guardian Responsibilities
Guardians are solely responsible for content posted, privacy settings, communications, information accuracy, and managing squad invitations.
2A.4 Minor Safeguards
Guardian-Managed Profiles have no independent login, route all messaging to the guardian, exclude gym-based strength stats, are ineligible for Team of the Week, and cannot participate in 1v1 comparisons.
2A.5 Release at Age 16
Release requires guardian SMS verification and child email verification. Upon release, full control transfers to the child and guardian access is permanently revoked.
2A.6 Automatic Lock at 18
If not released by 18, guardian control ends automatically. The adult user may claim the profile, or after 12 months unclaimed, the profile may be deactivated.
2A.7 Safeguarding Enforcement
The company may restrict accounts immediately for safeguarding concerns and may report serious concerns to authorities where required or appropriate.
3. Acceptable Use
You must not harass, bully, discriminate, post illegal or harmful content, attempt to contact minors outside the platform, groom or exploit minors, impersonate others, misrepresent identity or age, create automated accounts, bypass fees, or file malicious reports.
4. User Content
4.1 Ownership
You retain ownership of your content.
4.2 Licence
You grant the company a non-exclusive, worldwide, royalty-free licence to host, display, distribute, promote, and operate your content for platform purposes.
4.3 Responsibility
You are solely responsible for ensuring content is lawful and accurate. The company does not verify all user-submitted content.
4.4 False Content
False or misleading submissions may result in removal or suspension.
4.5 Promotional Use
The company may feature publicly visible content in marketing materials. You may opt out by contacting [email protected].
5. Intellectual Property
All platform rights including software, branding, logos, rankings systems, algorithms, and databases are owned by the company or its licensors. You may not reproduce, reverse engineer, or commercially exploit the platform without written consent.
6. Privacy
Your use is governed by the Privacy Policy.
7. Paid Features
7.1 Premium Services
Certain features require payment.
7.2 Refunds & Cancellations
Subscriptions (Premium, Scout Pro). Subscription fees are charged in advance for the chosen billing period and are non-refundable except where required by law. You can cancel at any time; your access continues until the end of the period already paid. Refunds outside this policy are exceptional and at The Rugby Factory's sole discretion.
Boosts and promotional placements. Boost purchases apply to active content only and take effect for the purchased duration. Boosts are non-refundable once active, with one exception: if boosted content is removed by The Rugby Factory following a report, we will refund the unused portion of the boost on a pro-rata basis (or in full where removal occurs within 24 hours of activation). No refund is due where the removal results from a clear violation of these Terms by the account that purchased the boost.
Sponsorships and advertising. Sponsorship and advertising purchases are governed by the term selected at purchase. Cancelling a sponsorship stops future billing; amounts already billed for the current period are not refunded except at our discretion.
Marketplace purchases. Refunds for purchases from clubs, groups or other sellers on the marketplace are handled per the seller's stated terms and applicable consumer law. Where a refund is issued, the seller's proceeds and The Rugby Factory's commission are reversed proportionally.
General. Refunds are always issued to the original payment method and can never exceed the amount actually paid after any discounts. Payment-processor fees are non-refundable. Chargebacks and payment disputes may result in immediate suspension of the associated purchase and, for marketplace subscriptions, cancellation of the underlying subscription.
Nothing in this section limits or excludes any rights you have under the Australian Consumer Law or other applicable law.
8. Competitions & Promotions
Participation may be subject to additional rules.
9. Third-Party Services
The company integrates with third-party services and is not responsible for their conduct.
10. Suspension & Termination
The company may suspend or terminate accounts for breaches or safety concerns. Notice will be provided where reasonably practicable, except where immediate action is required.
11. Disclaimers
The App is provided "as is." The company does not guarantee recruitment outcomes, team selection, sponsorship opportunities, career advancement, accuracy of rankings, or continuous availability. Statistics and rankings are indicative only, not professional advice.
12. Limitation of Liability
To the maximum extent permitted by law, the company is not liable for data loss, user conduct, platform interruptions, or reliance on platform content.
13. Indemnity
You indemnify the company for claims arising from your content, misuse, or breach of these Terms.
14. Reporting & Moderation
Users may report content or profiles. The company may remove content, restrict features, require verification, or suspend accounts. Appeals may be submitted to [email protected].
15. Changes
The company may update the App or Terms. Continued use constitutes acceptance.
16. Governing Law
Governed by the laws of New South Wales, Australia.
17. General
These Terms constitute the entire agreement. If any provision is invalid, remaining provisions remain in effect. The company may assign these Terms in connection with merger or acquisition. The company is not liable for events beyond reasonable control.
